Important victory! Right to 2 weeks pay in lieu of notice
Arbitrator Graham Clarke recently delivered a significant ruling for workers who were furloughed and not recalled when severance was due at the 1 year mark of the furloughs. The Code also affords workers with 2 weeks notice or pay in lieu of notice when severance triggers terminations under the Code. The IAM was able to successfully argue that the notice is to be working notice. Essentially the layoff doesn’t count as working notice as the workers were not working.
